History of Judge Capacities Improvement

Law of The Republic Indonesia Number 22 of 2004 on Judicial Commission of the Republic of Indonesia as amended by Law of The Republic Indonesia Number 18 of 2011 on Judicial Commission mandates the authorities and duties to, propose supreme court judge to DPR; and uphold the honour and dignity as well as to maintain the behavior of judges. In addition, Judicial Commission of the Republic of Indonesia (KYRI)  also get additional duty that is "to strive to improve the capacity and welfare of judges”.

To be able to execute authorities and duties of Improving Judge Capacities and prosperity requires such a standard or reference, so that all efforts to Improve Judge Capacities and prosperity can become more measurable and purposeful in nature. For that reason, in year 2012 KYRI had started it by establishing Judge Capacities Improvement Grand Design (GDPKH).

Pursuant to GDPKH, what needs to be conducted by KYRI to enhance judge capacities is the efforts to form character, attitude awareness, and motivation (affective aspect), and interest development and knowledge (cognitive aspect), and also skill (psychomotor aspect). GDPKH sets out the activities which must be performed, one of which was to carry out training on the Improvement of Judge Capacities.

The training that will be carried out should be adjusted with the result of training needs identification so that training will be conducted in accordance with the needs of judges. In general, training need analysis has been carried out during the preparation of GDPKH, where an enhancement in the capacity of judges to be done has focused on two aspects: legal knowledge competency and commitment to KEPPH.

In general analyse requirement of training has been conducted when establishing GDPKH, whereby the Improvement of Judge Capacities to be conducted is from two aspect namely competency in legal aspect and commitment aspect to KEPPH. Legal Knowledge competency aspect comprises the principles of justice, law method, understanding laws and regulations which are relative new, mastery of law in the society life sector, and mastery in applying method and invention of law. While commitment aspect to KEPPH, includes understanding, applying, and upholding KEPPH.

Both aspects of Judge Capacity Improvement above, if seen from educational psychology approach, it can conclude that the competency of legal knowledge is closely related to cognitive and psychomotor domains of the judge, though in certain level it can not be separated from affective domain.

While commitment aspect dealing with to understand, to apply, and to uphold KEPPH is closely related to affective and psychomotor domains, even though it can not be definitely separated from cognitive domain.

Thereby Improvement of Judge Capacities training that was executed by KYRI hasto comprise ; judge personality reinforcement (affective aspect), judge skill improvement in  examining, judging, and deciding the cases (psychomotor aspect), and judge improvement in legal knowledge(cognitive aspect).

Based on the analysis of training needs and educational psychology approach above, Improvement of Judge Capacities training in order that it can be able to run purposefully and measurably, then, in GDPKH and Improvement of Judge Capacities training Guidelines, KYRI has established several conditions that must be carried out, which is among others: training classification into three types, that are; KEPPH Training, Special Training, and Thematic Training. The three types of training will be conducted by KYRI in two forms, namely: 1. face-to-face and 2. Distance training (e-learning).
